1. NO PURCHASE NECESSARY: You must be twenty-one (21) years of age or older as of date of entry and a legal resident of the United States to be eligible. Void in California, Maryland, Tennessee and where prohibited by law.
2. HOW TO ENTER: To enter, follow the links when you visit the contest page on www.maxim.com web site and complete and transmit the on-screen entry form, including your name, home address, e-mail address, phone number, date of birth, and gender. Sweepstakes will run from 12:01 a.m. Eastern Time on October 11 2007, through 11:59 p.m. Eastern Time on November 1, 2007. Limit one entry per person per e-mail address. Duplicate entries will be disregarded. In the event of conflict, prize will be awarded to the owner of the e-mail address. Sweepstakes Entities (defined below) are not responsible for transmission and/or computer error. E-mail transmissions and / or internet transmissions that are misdirected, illegible, or not received due to technical malfunction will not be eligible. All entries become the sole property of Sweepstakes Entities and will not be returned or acknowledged. All entries must be received between 10/11/07 (12:01 am EST) and 11/1/07 (11:59 pm EST).
3. WINNER SELECTION: One (1) Grand Prize Winner will be selected in a random drawing from among all eligible entries. The drawing will take place during the week of 11/2/2007 and will be conducted by the Sweepstakes Entities. The selection of the winning entries shall be within the sole discretion of the Sweepstakes Entities, whose decision concerning all aspects of this sweepstakes shall be final. Odds of winning depend on the number of eligible entries received.
4. ELIGIBILITY: Employees of Dennis Digital, Inc., Brown-Forman Corporation, Southern Comfort Company, Arnold Worldwide, and Universal McCann, a division of McCann Erickson Worldwide, Inc. (collectively “Sweepstakes Entities”), or any of their respective parent companies, subsidiaries, affiliates, liquor wholesale licensees, retailers, as well as advertising/promotion agencies, and the immediate family members and household members of each are not eligible to enter this promotion. Open to legal residents of the United States, 21 years of age or older as of date of start. This promotion is void in California, Maryland, Tennessee, and wherever prohibited or restricted by law. Sweepstakes is subject to all applicable federal, state and local laws and regulations of the United States. By entering this Sweepstakes, entrants accept and agree to be bound by these Official Rules and the decisions of the Sweepstakes Entities, which shall be final, binding and conclusive on all matters. In the event that the sweepstakes is challenged by any legal or regulatory authority, Sweepstakes Entities reserve the right to discontinue or modify the sweepstakes, or to disqualify participants residing in the affected geographic areas. In such event, Sweepstakes Entities shall have no liability to any entrants who are disqualified due to such an action.
5. PRIZES: Grand Prizes (1): Grand Prize consists of three (3) day / two (2) night trip for two people to New York, New York. Prize includes roundtrip coach airfare for two (airline to be selected within the sole and absolute discretion of Sweepstakes Entities) from the US gateway airport closest to the winner’s home to New York, accommodations for two nights (double occupancy) at a hotel to be selected and determined in the sole and absolute discretion of Sweepstakes Entities, ground transportation between the airport and hotel, and two tickets to a concert at the Blender Theatre on November 8, 2007 (concert to be selected within the sole and absolute discretion of Sweepstakes Entities, subject to availability). Approximate retail value of Grand Prize is $2,000. Actual retail value of the Grand Prize may vary depending upon city of departure. If the major airport closest to the Grand Prize Winner’s residence serves the greater New York City metropolitan area, the Grand Prize will not include air transportation or land transfers to the hotel and no substitution or compensation will be provided. All expenses not specifically referred to herein shall be the responsibility of the Grand Prize Winner. Grand Prize Winner and guest must travel on the same itinerary. All federal, state and local laws and regulations apply. Taxes, if any, are solely the responsibility of the Grand Prize Winner. Winner and guest must be available to travel November 7-9, 2007, or on any other dates selected within the sole and absolute discretion of the Sweepstakes Entities pursuant to two weeks’ advance notice. Dates of trip and travel arrangements to be selected and determined in the sole and absolute discretion of the Sweepstakes Entities, subject to availability. Blackout dates and restrictions may apply. Grand Prize Winner and guest are responsible for all required travel documentation. No substitution, transfer, assignment or cash equivalent of prize permitted, except that Sweepstakes Entities may substitute any prize of equal or greater value for any reason unclaimed Prize may not be awarded.. Failure to return any required documentation so as to be received within five (5) days of prize notification will result in automatic prize forfeiture. If prize is forfeited for any reason, an alternate winner will be chosen in a random drawing of all eligible entries.
6. PARTICIPATION: Participants agree that by submitting their entry they release the Sweepstakes Entities from any liability in connection with their computer equipment/software. The Sweepstakes Entities are not responsible for any problems or technical malfunctions or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any material in this promotion. Use of automated entry devices or programs is prohibited. Any attempts to access the site via a bot script or other brute-force attack will result in that IP address becoming ineligible for the entire sweepstakes. Sweepstakes Entities (defined below) are not responsible for any incorrect or inaccurate entry information, human error, technical malfunction, failures, omission, interruption, deletion, or defect of any telephone network, computer on-line systems, computer equipment, servers, access providers, or software, including any injury or damage to participants’ or any other persons’ computers relating to or resulting from participation in this Sweepstakes; inability to access the entry website or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entry submissions that are processed late or incorrectly or are incomplete, garbled, or lost due to computer or electronic malfunction or traffic congestion on the Internet or any website. Proof of entering information at website is not considered proof of delivery or receipt.
7. CLAIMING PRIZE/RELEASE: Potential Grand Prize winner will be notified via telephone, regular mail and/or e-mail. Grand Prize Winner is not required to be online at time of notification.
The potential winner will be required to claim his or her prize within twenty-four (24) hours of notification by signing before a notary, and returning to the address stated in the notification an Affidavit of Eligibility and Liability/Publicity Release. The winner’s guest be at least 21 years of age and must meet all eligibility requirements of this Sweepstakes, and must also execute and return an affidavit of eligibility/release of liability and publicity release by the deadline specified in order for the guest to be permitted to accompany the Winner. If the notarized Affidavit of Eligibility and Liability/Publicity Release are not returned so as to be received within twenty-four (24) hours of notification, the winner will have waived any claim to the prize and an alternate winner may be selected. If any prize is forfeited for any reason, an alternate winner will be chosen in a random drawing of all eligible entries. The return of the notarized Affidavit of Eligibility and Liability/Publicity Release within the allotted time shall be the sole responsibility of the winner; Sweepstakes Entities are not responsible for delays in delivery. This Sweepstakes shall be governed by and construed in accordance with New York law, and the venue for all controversies will be exclusively in state or federal court in New York, New York. All federal, state and local taxes are exclusively the responsibility of the winner.
By entering this Sweepstakes, all entrants including the prize winner: (a) hereby release the Sweepstakes Entities and their respective parents, affiliates, subsidiaries, licensed alcohol wholesalers, retailers, officers, directors, agents employees and all others associated with the development and execution of this Sweepstakes from any and all liability claims, action or proceedings with respect to or in any way arising from or for injuries or damages sustained while involved in a promotion activity or in connection with this Sweepstakes and / or award, acceptance or use of the prizes, including liability for personal injury, death, damages, or monetary loss, and including the risks of travel and of attendance at public events; as well as (b) consents to the use by the Sweepstakes Entities for promotional purposes in connection with any promotion, of his or her name and/or likeness and/or voice and/or photographs, in any and all media, without additional compensation, except where prohibited by law. Winner and guest must be at least twenty-one (21) years of age as of date of entry. For the name of the Grand Prize Winner, send a self -addressed stamped envelope to: “SoCo Legendary Nights” Sweepstakes, c/o Dennis Digital, Inc., 1040 Avenue of Americas, 22nd Floor, New York, NY 10018 by December 31, 2007.
Computer entries will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain with the submitted e-mail address.
8. LIABILITY: Sweepstakes Entities reserves the right in its sole discretion, to change or suspend this sweepstakes should virus, bugs, or other causes beyond the control of sponsor corrupt the administration, security, or proper play of the sweepstakes. The Sweepstakes Entities reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel for error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft or destruction or unauthorized access to, or alteration of, entries.
9. CAUTION: Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the sweepstakes is a violation of criminal and civil laws and should such attempt be made, Sweepstakes Entities reserve the right to seek damages from any such attempt. Sweepstakes Entities reserves the right to seek damages from any such entrant to the fullest extent of the law.
10. PRIVACY: Any personal information supplied by entrants to Dennis Digital, Inc. will be subject to Dennis Digital, Inc.’s privacy policy and terms of service located at www.maxim.com. Additionally, by opting into specific offers from the Sweepstakes Entities, your personal information will be subject to each entity’s respective privacy policies and you agree to receive additional e-mail communications from those entities.
